1.General Terms.
1.1 These Terms and Conditions of Purchase / Sale of Goods (hereinafter - the Terms and Conditions) are a mandatory legal document governing the rights and obligations of the Buyer and the Seller when purchasing goods from the Goodstore.lv online store.
1.2 The Seller reserves the right to change or supplement these Terms and Conditions at any time in accordance with the legislation of the Republic of Latvia. The Seller has the possibility to get acquainted with the changes of the Terms and Conditions on the home page of the online store. The Buyer is subject to the terms and conditions in force from the moment of purchase.
1.3 The following may purchase goods from the online shop:
1.3.1. Natural persons who have reached the age of majority;;
1.3.2. minors between 14 and 18 years of age only with the permission of their parents or guardians, unless they are lawfully disposing of their income;
1.3.3. legal persons;
1.3.4. Legal representatives of all the above.
1.4 The Seller, by approving these Terms and Conditions, warrants that, subject to clause 1.3, the Purchasers are entitled to purchase the Goods from the Goodman Group Ltd - goodstore.lv online shop.
1.5 The agreement between the Seller and the Buyer is concluded from the moment when the Buyer has placed an order in the online shop, indicated the delivery address, chosen the payment method and read the terms of use of the online shop, as well as confirmed his order by clicking the button - place order (see point No. 5 - ordering the goods, price, payment procedure, terms).
1.6 Each contract concluded between the Buyer and the Seller is stored in the online shop's database.
2. Information about the Seller
2.1 These Terms and Conditions apply to the purchase of Goods from www.goodstore.lv (the "Online Shop"). The Seller is SIA "Goodman Group", Reg.No. 41503064521, legal and factual address Vidus iela 32, Daugavpils, LV-5401. The Seller's VAT registration number is LV41503064521.

3. Goods
3.1 The images of the Goods in the Online Shop are for illustrative purposes only. Whilst the Seller makes every effort to display the colours of the Goods as accurately as possible, the Seller cannot guarantee that the screen of the Buyer's device will display the colours of the Goods accurately. The Buyer understands that the Goods may differ materially from their images. Similarly, images of the Goods displayed in the Online Shop may show additional accessories or components which are not included in the packaging of the Goods sold. Goods shall be deemed to be as offered if they correspond to the sample, model and/or description provided in the Online Shop. The Goods shall be deemed to be in conformity with the offer if they correspond to the sample, model and/or description provided in the Online Shop.
3.2 The packaging for transport of the Goods may differ from that shown in the images in the Online Shop. Changing the packaging of the Goods in order to ensure the correct and safe transportation of the Goods does not alter the Goods and/or their features and/or functions as indicated in the Online Shop.
3.3 The Seller reserves the right to set a minimum and/or maximum order quantity for a particular Goods in a single order.
4. Protection of Personal Data.
4.1 The Buyer may order the Goods from the Online Shop:
4.1.1. by registering - by entering the personal data required for registration.
4.1.2. without registration.
42.3 By accepting these terms and conditions, the buyer agrees that his/her data as specified in clause 4.2 will be used to ensure the delivery of the goods as well as for delivery and marketing analysis.
4.4 By signing these terms, the buyer agrees that his data will be processed for the purpose of the sale and delivery of the goods and the buyer agrees that he will receive messages relating to the order of the goods to the telephone number and email address provided.
4.5 The Buyer undertakes to keep and not to disclose to anyone his/her login details when registering in the Online Shop and when ordering goods.
4.6 The Buyer agrees that the personal data that he voluntarily provides in the registration form will be processed in accordance with these Terms and Conditions.
4.7 The Buyer has the right to access his personal data and the right to request the rectification, blocking or deletion of incorrect, incomplete or erroneous personal data. In this case, the Seller shall comply with the Buyer's request without delay, but at the latest within 2 working days.
4.8 The Buyer has the right to be informed about the sources and data of his personal data, the purpose of their processing, the recipients to whom the data are provided and which have been provided at least in the last year.
4.9 The Buyer has the right to request the rectification, erasure or suspension of the processing of his personal data, with the exception of storage, if the data are processed in breach of the provisions of the law.
4.10. Goodman Group Ltd online store Goodstore.lv as the Data Controller recognises and respects the right to privacy of each Buyer who registers online. The Data Controller collects and uses the Buyer's personal data (name, address, telephone number, e-mail address and other information provided in the online shop registration form) in order to process orders for goods or services or to fulfil other contractual obligations. By placing an order or registering, the Customer agrees to the Terms and Conditions of Sale and Purchase of Goods, which state that by accepting these Terms and Conditions, the Customer agrees that the personal data provided by the Customer will be processed by the online store "Goodstore.lv" in order to analyse the activities of the Seller and use it for marketing purposes. This includes the sending of advertising and informative messages, by registering the Buyer agrees to receive newsletters and similar materials, from which the Buyer has the right to unsubscribe. The Seller undertakes not to use personal data unlawfully or in a way that may harm the security of the Buyer's data.
4.11 The Data Controller undertakes not to disclose the Buyer's personal data to third parties, other than the Data Controller's partners providing the delivery of goods or other services related to the exact execution of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure established by the legislation of the Republic of Latvia.
4.12. Personal data shall be processed using secure measures to protect the data from unlawful erasure, disclosure or other unlawful activities.
4.13. Persons who have consented to their data being used for direct marketing purposes are kept in an active database and used for direct marketing purposes for 2 years. Customer data is stored for 2 years after the last purchase. After this period, the customer data is (automatically) deleted. The automatic deletion of personal data is monitored by the person responsible.
5. Rights and obligations of the Customer.
5.1 The Customer has the right to purchase goods from the Online Shop in accordance with these Terms and Conditions and any other procedures set out in the information sections of this Online Shop.
5.2 The Buyer has the right to withdraw from the contract of sale by informing the Seller, specifying the goods to be returned and the order number, no later than 14 days after receipt of the goods.
5.3 The Buyer's rights under clause
5.2 shall only apply if the returned goods have not been used or damaged in any other way.
5.4 The Buyer undertakes to accept the goods ordered and to pay the amount specified.
5.5 If the data registered by the Buyer changes, it must be updated immediately.
5.6 The Buyer undertakes not to pass on the online shop registration data to third parties. If the registration data are accidentally lost, the Seller must be notified immediately in the contact section.
5.7 The Buyer, using the services of this shop, agrees to the terms of sale and undertakes to comply with them and not to violate the legislation of the Republic of Lithuania.
6. Rights and obligations of the Seller.
6.1 The Seller undertakes to improve all conditions for the proper use of the Online Shop by the Buyer.
6.2 If the Buyer attempts to damage the stability and security of the Seller's online shop or breaches the obligations, the Seller shall have the right to immediately and without prior notice restrict or suspend the Buyer's access to the online shop or in exceptional cases cancel the Buyer's registration.
6.3 The Seller undertakes to respect the Buyer's right to privacy with respect to the Buyer's personal information provided in the Goodstore.lv online shop registration form.
6.4 The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.
7. Order, prices, delivery procedure and duration.
7.1 The minimum order amount is EUR 5.00 (five euro 00 cents).
7.2 The Customer may shop in the Online Shop 24 hours a day, every day.
7.3 These Terms and Conditions shall come into force at the time when the Buyer confirms his order and the Seller sends a confirmation of purchase to the e-mail address provided by the Buyer.
7.4 The prices in the online shop are quoted in EUR, including VAT, on the product and in the order.
7.5 The Buyer may pay for the goods in the following ways:
7.5.1. payment via internet bank or credit card - SEB banka, Swedbank, Luminor banka, Citadele, Revolut, VISA or Mastercard.
7.5.2. direct bank transfer
7.5.3. payment of the invoice within the time limit specified in the invoice.
7.6 The Buyer undertakes to pay for the order immediately, as the Seller shall only start processing the order after receipt of payment.
7.7 The Seller shall issue an electronic version of the invoice, a pre-paid version of the invoice, to the Buyer by e-mail, which shall be received immediately upon confirmation of the order. The final invoice shall be issued upon payment, a paper version of such invoice shall be delivered with the goods, an electronic version shall be sent by e-mail.
8. Delivery
8.1 The Goods shall be delivered within the territory of Latvia.
8.2 The Buyer may choose to collect the Goods in person at the office of Goodman Group SIA, Vidus iela 32, Daugavpils, LV-5401, by Venipak courier or Venipak courier.
8.3 When choosing the delivery method, the Buyer must specify the delivery address.
8.4 The Buyer undertakes to accept the delivered goods. In the event that the Buyer is unable to collect the Goods at the time of delivery, the Buyer shall have no claim against the Seller for delay in delivery.
8.5 The goods shall be delivered by the Seller or by a person authorised by the Seller (courier).
8.6 The Seller shall deliver the Goods within 3-14 working days from the confirmation of the Order. The Buyer agrees that in exceptional circumstances the delivery date may be changed for reasons beyond the control of the Seller. In such event, the Seller shall inform the Buyer immediately and agree a time for delivery. The maximum delivery time will not exceed 30 working days.
8.7 The Seller shall be discharged from liability for delay in delivery of the Goods if the delivery of the Goods is delayed or not made for reasons beyond the control of the Buyer or the Seller.
8.8 The Buyer must notify the Seller immediately if the Goods are received in damaged packaging.
8.9 If the goods are received in damaged packaging, the Buyer must note the nature of the damage on the courier note in the presence of the courier at the time of receipt of the goods. Failure to do so shall release the Seller from any liability for the damaged goods.
9. Quality and guarantee of the goods.
9.1 The Seller warrants the quality of the Goods (legal quality guarantee). The Seller grants a quality guarantee for different types of Goods valid for a specified period of time, the specific duration and other conditions of which are specified in the documents supplied with the Goods.
9.2 Photographs of the Goods are for illustrative purposes only, original products may differ from those shown. Photographs of the Goods inserted cannot be used as a basis for any claim. The Goods shall be deemed to be in conformity if they correspond to the sample, model or description provided in the online shop.
9.3 The warranty provided by the Seller does not limit the rights of the Buyer, which are determined by the laws and regulations of the Republic of Latvia in case of purchase of goods of inadequate quality.
9.4 Defective Goods shall be rectified and non-conforming Goods shall be replaced or returned in accordance with the procedures set out in these Conditions and taking into account the requirements of the applicable laws of the Republic of Latvia.
9.5 The Buyer who wishes to complain about faulty or incomplete Goods may do so by e-mail veikals@goodstore.lv
9.6 When submitting a complaint, the Buyer must provide the following information:
(a) Proof of payment for the Goods and the order number;
(b) the defect, signs of damage or missing part of the Goods;
(c) provide other evidence such as a photograph of the Goods, a photograph of the defective area (if it is a mechanical defect and can be photographed), a photograph of the packaging of the Goods, etc.
9.7 When making a complaint, the Buyer must specify one of the ways in which the Buyer wishes the complaint to be resolved:
(a) by the Seller remedying the non-conformity of the Goods - defects - without charge within a reasonable time if the defects can be remedied under the terms of the warranty;
(b) an appropriate reduction in the purchase price, taking into account the wear and tear of the Goods or the benefit derived by the Buyer from the use of the Goods and agreed between the Seller and the Buyer;
(c) replace the Goods with analogous Goods of the same quality without charge within a reasonable time, except where the defects are minor/insignificant or due to the Buyer's fault;
(d) cancel the Contract and refund to the Buyer the amount paid for the Goods, except where the non-conformity of the Goods is minor and not likely to affect the Buyer's ability to use the Goods. A non-conformity of the Goods shall be deemed to be minor if it does not materially impair the performance or usability of the essential functions of the Goods and can be remedied without causing any visually detectable change in the external appearance of the Goods.
9.8 Upon consideration of a complaint, a response shall be provided within 15 (fifteen) days of receipt of the complaint. If, for objective reasons, it is not possible to reply to the Buyer's complaint within that period, the Seller shall immediately inform the Buyer in writing, indicating a reasonable period within which a reply will be provided and justifying the need for such an extension.
10. Return of quality goods
10.1 Goods may be returned within 14 days of receipt by sending the Seller a notice of return stating the order number of the Goods and the reason for return (optional). In all cases, the money for the returned goods will only be refunded to the account specified by the Buyer.
10.2 When returning an item, the Buyer must follow the following procedure:
10.2.1. the goods must be in their original packaging;
10.2.2. the goods must not be damaged;
10.2.3. the goods must not have been used or tested more than is possible by checking the goods in the shop.
10.3 The Seller has the right to refuse to accept the goods if any of the above points are not met.
10.4 If the Goods have a manufacturing defect or if another Goods were sent in error, the Seller undertakes to accept the Goods and to exchange them for an equivalent Goods.
10.5 In the event that the Seller is unable to exchange the Goods, the price of the Goods shall be refunded to the Buyer.
11. Buyer's and Seller's Liability.
11.1 The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller shall not be liable for the consequences and shall be entitled to claim compensation for direct damages.
11.2 The Buyer is responsible for the actions carried out through the "Goodstore.lv" online store.
11.3 The registered Buyer is responsible for the transfer of his login data to third parties.
11.4 The Seller shall be exempt from any liability in the event that the loss is caused by the Buyer, despite the Seller's advice and the Buyer's obligations, failing to read these Terms and Conditions, even though the Buyer was given the opportunity to do so.
11.5 Where the Seller's online shop contains links to the websites of other companies, institutions, organisations or individuals, the Seller is not responsible for the information or actions taken therein and does not maintain, control or represent such companies and individuals.
11.6 In the event of damage, the party at fault shall indemnify the other party for direct damages.
12. Marketing and Information.
12.1 The Seller may launch various promotions on the Online Shop at its sole discretion.
12.2 The Seller shall be entitled to unilaterally, without separate notice, modify the terms of promotions as well as to cancel them. Changes and cancellations of promotional terms and conditions shall be effective only from the date of their commencement and shall not apply to orders placed prior to the announcement of the promotions or changes thereto.
12.3 The Seller shall send all notices by the means of communication specified in the Buyer's registration form.
12.4 The Buyer shall send all notices and enquiries to the telephone number or email address provided in the "Contact" section of the Seller's online shop.
12.5 The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to the Internet connection, email provider network failures.
13. Events beyond the Seller's control
13.1 The Seller shall not be liable for any failure to perform or delay in performance of the Contract or any obligations under the Contract if such failure or delay is due to Force Majeure.
13.2 In the event of an event beyond the Seller's control affecting the proper performance of the Seller's obligations under the Contract:
(a) the Seller will promptly notify the Buyer; and
(b) performance of the Seller's obligations under the Contract will be suspended and the time for performance of the obligations will be extended by a period equal to the duration of the event beyond the Seller's control. If events beyond the Seller's control affect the delivery of the Goods to the Buyer, the Seller will agree a new delivery date after the end of the events beyond the Seller's control.
14. Sending information
14.1 As used in the Conditions, "in writing" includes emails.
14.2 The Buyer shall, in order to communicate with the Seller in writing or in the event that the Conditions require the Buyer to communicate with the Seller in writing, send an e-mail to the Seller at veikals@goodstore.lv or a regular letter addressed to Goodman Group Ltd, Vidus iela 32, Daugavpils, LV-5401. The Seller will inform the Buyer in writing of the receipt of the notification (usually by e-mail). The procedure for exercising the right of withdrawal and withdrawal from the Contract by the Buyer to the Seller is set out in the relevant paragraphs of these Conditions.
14.3 The Seller shall send all notices to the Buyer to the email address provided by the Buyer on the Purchase Form.
15. Final Matters.
15.1 These Terms and Conditions of Sale are made in accordance with the laws and regulations of the Republic of Latvia.
15.2 Any disputes concerning the performance of these Terms shall be settled by negotiation. If no agreement is reached, a solution shall be sought in accordance with the laws of the Republic of Lithuania.
